General terms and conditions of sale
ARTICLE 1 - PURPOSE
Billetweb is a Ticketing solution (hereinafter referred to as "the Ticketing Service") published by Trustweb (hereinafter referred to as "the Company"). Said Ticketing service enables organisers (hereinafter referred to as "the Organisers") of events (hereinafter referred to as "the Events") to offer their Tickets (referred to in this contract as "the Tickets") for sale on the www.billetweb.fr website (hereinafter referred to as "the site"). The purchasers of these Tickets are then referred to hereinafter as "the Purchasers". The holders and users of the Tickets are referred to as "Participants".
These general terms and conditions apply to all ticket purchases made through the Billetterie. Billetweb acts as an intermediary at the marketing stage but never intervenes at the event organisation stage. The Organisers are therefore fully responsible for the running of the event. These general terms and conditions do not apply to the event itself. The Organisers may add their own conditions concerning the holding of the event itself in a document which will be presented to you following these terms and conditions.
ARTICLE 2 - RATES
Ticket prices include, in accordance with the rules in force, the currency. Unless otherwise stated, the prices indicated on the Ticket are inclusive of all taxes.
As the organisers have the right to modify the various prices during the sales period, the company will invoice on the basis of the prices in force at the time the order is created by the participant.
ARTICLE 3 - AVAILABILITY
The ticket office informs you in real time of the availability of products when you place your order. If certain tickets are no longer available between the beginning and end of your order, the system will inform you. You will be able to check the contents of your order before validation and payment.
ARTICLE 4 - INVESTMENT
Unless otherwise stated at the time of booking and on the ticket, seating is free. If the Organiser has chosen to set up a seating system, you will be invited to choose your seat or zone during the booking process. The location on the map or diagram is provided for information only. It is intended to be as representative as possible but has no contractual value.
ARTICLE 5 - PERSONAL DATA
In accordance with Act no. 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties, the processing of your personal data is subject to a declaration to the Commission Nationale de l'Informatique et des Libertés (CNIL) under declaration number 1759026.
You have a permanent right of access to and rectification of all data concerning you, in accordance with European texts and national laws in force. All you have to do is send a request by e-mail (contact@Billetweb.fr)
When placing your order, you are asked to provide personal information about your identity and that of the Participants.
The information necessary to ensure the processing of the order by the Billetterie is: surname, first name and e-mail address of the Purchaser. It may also be used by Billetweb to contact you in the event of a problem with the processing of your order.
Other information may be collected at the request of the Organiser, particularly in the event of a postponement or cancellation of the Event. The Company collects this data on behalf of the Organiser and brings it to the Organiser's attention. The Organiser is then responsible for the correct storage and use of the data to which it may have had access. Our system hosts the data for a period of 1 to 5 years following the end of the event (this parameter is defined by the Organiser). After this period, the data is anonymised.
By accepting these General Terms and Conditions of Sale, you expressly authorise the Company to transmit your personal data to the Event Organiser. The Company may not be held responsible for any use that may be made of this data. The Organiser is solely responsible for the management and content that it sends to the Participant.
If you create or use a buyer account to place an order, you authorise Billetweb to collect, store and process your data. When you make a subsequent reservation using this account, you authorise Billetweb to transmit part of your data to the organiser for whom you are placing this order. This data is kept for a period of 5 years from the last purchase made by the purchaser.
ARTICLE 6 - PAYMENT Confirmation of your order implies your obligation to pay the price indicated. Only one method of payment is authorised per order.
6.1 Payment by credit card
It is possible to pay for your order by "Carte Bleue", "VISA", "EUROCARD" or "MASTERCARD". This payment is processed by our banking partner. This partner's contact details can be found on the site's "legal information" page. Payment by card may use the 3D Secure system, which aims to identify the cardholder in order to limit fraud.
Once the transaction has been validated by the bank, your bank account will be debited for the amount of the order. At the end of the transaction, an order confirmation will be sent to you by e-mail. You will be able to download an invoice from it.
In the event that a payment is invalidated by the bank, once your Ticket or order has been issued, it will be invalidated and you will not be granted access to the event.
Exchanges with the billetweb.fr website are secured by SSL encryption. The buyer's bank details are not stored by our system. Online electronic payments are made on the Billetweb site or directly on the site of the company's banking partner, which ensures security using appropriate encryption and authentication technologies.
6.2 Alternative payment
In cases where the Organisers allow and authorise "offline" payment, the Billetweb system will "reserve" your order. Once payment has been received by the Organisers and validated by them via the Billetweb system, the order will be sent by e-mail to the purchasers in accordance with the aforementioned procedures
ARTICLE 7 - ORDER CONFIRMATION
Once your order has been paid for, a confirmation message is displayed. An order confirmation email containing your tickets will be sent immediately. It is then your responsibility to check that you have received your tickets. Please note that some courier providers may delay the delivery of tickets. If tickets are not received after several hours, please contact the organiser or Billetweb customer service. It is possible to check the payment of an order or to return tickets from the ticket sales module. Non-receipt of the order does not invalidate the order.
ARTICLE 8 - ISSUE AND CONDITIONS OF USE OF TICKETS
Delivery Electronic Tickets or a link enabling them to be downloaded are sent to the Buyer's electronic mailbox after each order.
Characteristics In accordance with the regulations, each Ticket includes the following information in visible or coded form:
Identification of the Organiser
Name of event
Tariff name
Price paid by the buyer
In order to be accepted, the Ticket must be printed in black and white or colour on blank white A4 paper. The paper must be completely intact and legible: damaged or illegible Tickets will not be considered valid.
The presentation of a Ticket via a digital medium (Tablet, Smartphone) will only be accepted if the Organiser expressly stipulates this in the information appearing on the Ticket. The Participant remains responsible for being able to present the Ticket on the digital medium at the entrance to the event.
Billetweb declines all responsibility for any anomaly that may occur during the ordering, downloading or printing of a Ticket. No duplicates other than the original Ticket will be issued.
Uniqueness A Ticket may only be used once to gain access to the event. Therefore, in the event of loss, theft or duplication, only the first person to present the Ticket will be admitted to the event. Ticket holders who have already used their Ticket will not be entitled to any refund.
The Ticket is only valid for the place, date and time to which it belongs. The Ticket must be kept until the end of the event.
The Ticket may be nominative, depending on the settings made by the Organiser on the Ticketing system. In this case, in addition to the identity of the purchaser, that of the beneficiary will be indicated on the Ticket. Nominative Tickets remain personal and non-transferable, except with the express prior authorisation of the Organisers
The Ticket is unique, comprising an identification number and a bar code. Reproduction, duplication or counterfeiting of Tickets is prohibited. The Organisers reserve the right to refuse access to the event site (or to the event). No refund will be given in this case
Checks The Organiser is free to check the validity of Tickets at the time of access to the event. He is not obliged to check the identity of the beneficiary of the Ticket given that the Ticket has a unique and unpredictable identifier. The Participant must therefore ensure the confidentiality of his/her Ticket. Access to the Event may be refused to a Participant who presents a Ticket that has already been used. The Organiser is not obliged to check the authenticity of the Ticket.
Proof The Organiser is also free to check the identity of participants. If the Tickets are set up as nominative, the Participant must be able to prove his identity using an official document including a photograph.
The Organiser may request other proof of identity when granting access to the event. These will be communicated to the Participant via the order confirmation email and via the information on the Ticket.
ARTICLE 9 - REIMBURSEMENT
No right of withdrawal In accordance with the legislative provisions of article L121-20-4 of the French Consumer Code, Tickets may not be subject to a right of withdrawal. All orders are therefore legally considered to be firm and definitive.
Tickets cannot be refunded, even if lost or stolen, nor can they be taken back or exchanged. Refunds can only be made in two cases:
The event is cancelled or substantially modified
The organiser authorises the reimbursement and makes the funds available to reimburse
Refunds will only be made to the original purchaser. No costs of any kind whatsoever will be reimbursed or compensated. Any decision to cancel, postpone or modify an event is the sole responsibility of the Organiser
ITEM - 10 CUSTOMER SERVICE
For any request from the Buyer relating to the event or to the conditions of access, the Participant must contact the Organiser, whose contact details can be found on the Ticket sales page. If the request cannot be met, the organiser will contact Billetweb.
For any technical request relating to ticketing or marketing, the Participant may contact Billetweb using the means made available to him on the Billetweb website.
In the event of a dispute or default by the event organiser, the purchaser must contact Billetweb.
If the consumer has sent a complaint to Billetweb and has not obtained satisfaction or a response within two months, the buyer may have recourse to our mediator MCP Médiation, in accordance with the provisions of Articles L 611-1 and R 612-1 et seq. of the French Consumer Code concerning the amicable settlement of disputes. ARTICLE 11 - APPLICABLE LAW
The applicable law is French law, regardless of where the Event is organised. Any difficulty relating to the interpretation or performance of the contract shall fall within the jurisdiction of the Paris courts, regardless of the place of performance of the present contract and regardless of the domicile of the defendant.
In accordance with Article L121-20-3 of the French Consumer Code, Billetweb is automatically liable to the consumer for the proper performance of the obligations arising from the distance contract. Billetweb is then responsible for the transmission of the ticket.
However, Billetweb cannot be held responsible for the running of the Event and the performance of the Organiser's obligations during the Event. As the Event takes place under the sole responsibility of the Organiser, Billetweb shall not be liable for reasons such as cancellation, postponement, modification of the Event or any other incident that may occur during the Event.
ARTICLE 12 - ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS
The user declares that he/she has read and accepted these General Terms and Conditions of Sale as well as those that may have been added by the Organiser concerning the holding of the event. The connection and transaction data retained by Billetweb shall constitute proof.
